Terms & Conditions for Aviva Young Scholars’ Scholarship program:

• The "Aviva Young Scholars Scholarship Program" ("Contest") is organized by Aviva Life Insurance Company. India Ltd., ("Organizers").
• Participation in Contest is purely voluntary.
• The contest is open to schools approached by Aviva & Hindustan Times Pace in Delhi & NCR.
• Students from class 3rd to 8th will be eligible to take the test.
• Preliminary Contest shall be open from 00:00 hours on 9th July 2010 and close on 31st August 2010 at 23.59 hours ("Contest Period"). Entries received after the closing of the Contest Period shall not be considered and the same will be invalid. Organizers shall not be responsible for delayed, lost, mutilated, corrupted or illegible entries. Organizers have the sole and absolute right to close or extend the Contest by any time frame at their discretion.
• To get a chance to win in the Contest, candidate will have to participate in the Test conducted by HT Pace in his/her respective school. To be eligible for the contest, users would need to comply with the rules as set forth herein within the prescribed time period.
• If more than one entry is received from the same person, either through the same medium or otherwise, only one such entry, of Organizers' choice, shall be eligible for participation.
• The Final Winners will get a scholarship by cheque or kind.
• Organizers' decision in regard to winners shall be final and binding. No communication or objection shall be entertained in this regard.
• Prizes received under Contest shall not be transferable and cannot be exchanged for cash or otherwise. Prizes cannot be substituted for other articles or gifts.
• Names, addresses, telephone numbers, e-mail identities and/or photographs of Winners may be used by Organizers at their sole discretion for sending out commercial information and/or for other commercial, publicity or promotional purposes. Winners who do not wish to receive such information may select such option on Website/ form or clearly indicate so in a communication sent to Organizers by recorded delivery
• All entries and materials submitted to the Organizer in connection with the Contest (collectively, "Entry Materials"), along with all copyright, trademark and other proprietary rights associated therewith, become the property of Organizer upon submission, and Entry Materials will not be returned to any entrant. Without limiting the generality of the foregoing, you acknowledge that the Organizer, at its sole discretion, will own all rights to use, modify, reproduce, publish, perform, display, distribute, assign, make derivative works of and otherwise commercially and non-commercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to you or any other person or entity. You hereby irrevocably consent and agree to unrestricted use by the Organizer, its authorized representatives, advertisers, successor, sponsors, customers and assigns of the name, picture, voice or photographs, images etc of yourself and/ or with a group for advertising purpose or purposes of promotion, trade, press release or motion picture etc.
• By entering the Contest, you indemnify Aviva Life Insurance Co. India Ltd., participating sponsor’s and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Indemnified Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, mis-delivery, acceptance, possession, use of or inability to use any Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
• Organizers shall not be responsible for any cost, expense or other liability whatsoever in relation to, arising from or connected with Prizes. Organizers shall not be responsible for any injury, loss, damage or other consequence whatsoever arising from, suffered or incurred by Winner from or in relation to Prizes.
• Contest shall be subject to the laws of India, including tax laws, rules and regulations as may be applicable to Winners. Winners shall be solely responsible for payment of applicable taxes to concerned authorities in respect of the Prizes as may be required by law prior to delivery of Prizes.
• 16. Organizers offer no guarantee or warranty in respect of any of the prizes. The manufacturers, services providers, supplier of the Prizes alone shall be liable for any guarantee or warranty, if any.
• All costs and expenses for collecting, redeeming or utilizing the Prize/s will be borne by the respective Winner and no claim of whatsoever nature will be entertained by the Organizers in this regard. Apart from the entitlement to the prize, the winner or his/her legal heirs will have no other rights or claims against Aviva Life Insurance Co. India Ltd.
• Any disputes arising from or in relation to Contest shall be subject exclusively to New Delhi jurisdiction.
• Employees, officers and directors of Organizers, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies and legal advisors, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in the Contest.
• Participation in this Contest implies acceptance of all the terms and conditions of the Contest.
• 21. Organizers is not responsible, and shall not be liable, for: (a) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; or (d) any printing or typographical errors in any materials associated with the Contest.
• Aviva Life Insurance Co. India Ltd., has the sole right to suspend, postpone, cease, close or terminate this Contest at any given point of time at its sole option and discretion. The Contest and these Terms & Conditions will be governed, construed and interpreted under the laws of India. Contestants agree to be bound by these Terms & Conditions and by the decisions of the Organizer, which are final and binding in all respects. The Organizer reserves the right to change these Terms & Conditions at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Organizer’s control affect the administration, security or proper play of the Contest or the Organizer otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned.
• Contestants who violate these Terms & Conditions, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to the Organizer, the Contest or any other Contestant are subject to disqualification from entry into the Contest. The Organizer reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest. The Contestant agrees to abide by all rules as may be changed from time to time by the organizers and shall raise no objection whatsoever. The Organizer shall not be responsible in any manner whatsoever for any delays or non-receipt of applications or for acts of omission or commission on any account and for any reason whatsoever. The Contestant will have to participate in a disciplined and diligent manner.
• In case of any dispute the Organizer’s decision would be final
• Assessment of answer sheets will be carried out and winners declared on merit by a neutral / third party. In case of a tie, a neutral/third party will carry out a draw in order to declare the winner.
